Herbert & Ball was founded by a former solicitor and contract writing specialist with the goal of providing affordable, high quality, tailored legal advice and contract drafting and negotiation services to individuals and small and medium sized businesses.

We have expertise in a broad range of areas of law: including aviation, commercial, data protection, franchising, information technology and intellectual property. We do not conduct reserved legal activities (e.g. litigation, wills and probate or conveyancing) or any other activities we require authorisation or regulation to conduct (e.g. immigration law services).

How we differ
We keep our overheads and other costs to a minimum, allowing us to provide our clients with a premium level of service at a fraction of the price. Unlike law firms, we are not regulated by the Solicitor Regulatory Authority or the Bar Standards Board. This reduces compliance costs and gives us a greater degree of flexibility in how we operate.

Aviation
We have experience in drafting private-sector aircraft chartering agreements, including chartering contracts involving international medical air transport of patients in specialised aircraft.
Commercial
We assist clients with non-disclosure agreements, domestic and cross-border product distribution agreements, manufacturing licences, royalty agreements, agency agreements, novation and assignment agreements.
Data Protection
We focus on data protection policies, data sharing agreements, subject access requests, cross-border transfers and providing General Data Protection Regulation (GDPR) advice.
Franchising
We have experience in advising across a broad range of franchising issues, including multi-jurisdictional franchise development (both within and outside of the EEA), state aid issues surrounding market share and price fixing, import and export of goods, manufacturer’s warranties, training and franchise manuals. We also draft all types of franchise contracts, from single-tier domestic agreements to cross-border multi-tiered franchise development agreements.
Information Technology
We have very broad experience in both IT, software and internet law, including the preparation or review of end-user licence agreements, software user licences, software evaluation licences, software development contracts, software integration and VAR agreements, white-labelling, website terms and conditions (including acceptable use policies, privacy and cookies policies), cloud service contracts, email marketing contracts, end-user agreements, hosting contracts and SEO contracts.
